Terms of Service

By purchasing, downloading, installing, or using the SparkFlare EA software ("Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not purchase or use the Software.

SparkFlare EA is an automated trading software (Expert Advisor) designed for the MetaTrader 5 platform. The Software executes trading strategies based on predefined algorithms and parameters. The Software requires a valid subscription license to operate.

Upon purchase, you receive a non-exclusive, non-transferable license to use the Software for the duration of your subscription. The following restrictions apply:

• Each license is valid for one (1) MetaTrader 5 account only
• You may not resell, sub-license, rent, or lease the Software
• You may not decompile, reverse-engineer, or attempt to extract source code
• You may not share your license key or account credentials with others
• You may not use the Software to develop competing products
• Violations will result in immediate license termination without refund

Subscriptions are billed through Paddle as our Merchant of Record. By subscribing, you authorize Paddle to automatically charge your payment method at the start of each billing cycle. You may cancel your subscription at any time through your Paddle account. Cancellation takes effect at the end of the current billing period.

IMPORTANT: Trading foreign exchange, commodities, and CFDs carries a high level of risk and may not be suitable for all investors. Past performance is not indicative of future results. You should never trade with money you cannot afford to lose.

The Software is a tool that executes trading strategies. It does not guarantee profits and may result in significant losses. You are solely responsible for:

• All trading decisions and their outcomes
• Configuring appropriate risk parameters
• Maintaining sufficient account margin
• Monitoring the Software's operation
• Complying with your local laws and regulations

The Software, including all code, algorithms, designs, and documentation, is the intellectual property of SparkFlare Quantitative Strategy Studio. All rights reserved. Nothing in these Terms transfers ownership of the Software to you.

The Software is provided "AS IS" without warranty of any kind. We disclaim all warranties, express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy, completeness, or reliability of trading signals
• Uninterrupted operation or error-free performance
• Compatibility with all broker platforms or configurations
• That the Software will be free of bugs or vulnerabilities

To the maximum extent permitted by law, SparkFlare Quantitative Strategy Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or trading losses
• Loss of data or business information
• Business interruption
• Broker account losses or margin calls
• Any damages arising from the use or inability to use the Software

Our total liability shall not exceed the amount you paid for the Software in the twelve (12) months preceding the claim.

We reserve the right to terminate or suspend your license immediately, without notice, for any of the following reasons:

• Violation of these Terms
• Unauthorized sharing or redistribution of the Software
• Attempting to bypass licensing or copy protection
• Chargeback or payment fraud
• Any activity that harms our business or other users

We reserve the right to modify these Terms at any time. We will notify active subscribers of material changes by email. Continued use of the Software after changes constitutes acceptance of the new Terms.
